Divorce Mediation Documents. Open Financial Statement and Consent Orders

Learn which family mediation documents may be prepared after mediation, including Open Financial Statements, Memorandums of Understanding, parenting plans and consent orders.

Family mediation documents after mediation

Family mediation documents record what has been disclosed, discussed or proposed after mediation. Depending on the case, the written outcome may include an Open Financial Statement, a Memorandum of Understanding, a parenting plan or a consent order drafted later by a solicitor.

These documents have different roles. Some record factual financial information, some explain proposals, and some help turn a mediation agreement into a legally binding order.

What if family mediation documents are missing?

A missing statement does not always stop mediation. The key question is whether the information is needed before safe, informed proposals can be discussed.

Explain what is missing, why it is unavailable and what steps are being taken to obtain it. Replacement records may come from an online account, employer, pension provider, lender or accountant.

Estimates can sometimes be used temporarily, but important decisions should be checked against reliable evidence wherever possible.

Open Financial Statement

An Open Financial Statement records the financial disclosure provided by both participants, including assets, liabilities, income, pensions and debts. It is one of the key family mediation documents in financial cases.

Because it records factual information, it may be referred to outside mediation, including in court proceedings. Each participant should check it carefully before confirming it is accurate.

It gives discussions about property, maintenance and pensions a shared factual basis.

Memorandum of Understanding

A Memorandum of Understanding records the proposals reached in mediation and explains how the different parts of the settlement fit together. It often sits alongside the Open Financial Statement when financial proposals are being considered. It is usually prepared on a without prejudice basis and is not, by itself, a legally binding court order.

A solicitor may use it to draft a consent order. The court must approve that order before financial arrangements become legally enforceable.

Parenting plans after mediation

A parenting plan can record arrangements for where children live, time with each parent, holidays, handovers, communication and decision-making. A clear plan can reduce misunderstandings by setting out dates, responsibilities and review points. Many parents use a parenting plan voluntarily. Legal advice may be needed if a formal child arrangements order is being considered.

Consent orders after mediation

Mediators do not make court orders. If participants want a mediated financial agreement to become legally binding, a solicitor will usually draft a consent order for court approval.

The court considers whether the proposed order is fair, so accurate financial disclosure remains important even after agreement is reached.

Legal advice is especially important where pensions, property transfers, tax or international assets are involved.

Common family mediation document mistakes

Delays often happen when information is incomplete, outdated or mixed with proposals. Keep factual disclosure separate from settlement ideas.

Common mistakes include:

  • Providing account balances without the corresponding statements.

  • Omitting inactive, online or overseas accounts.

  • Using outdated mortgage or pension valuations.

  • Forgetting bonuses, dividends or employment benefits.

  • Leaving out debts owed to friends or relatives.

  • Estimating household expenditure without checking actual payments.

  • Submitting incomplete documents with missing pages.

  • Combining proposals with factual financial disclosure.

  • Sending large quantities of irrelevant correspondence.

  • Assuming a written mediation summary is automatically legally binding.
